Teatro Viriato’s Privacy Policy

1. Privacy Notice

On April 27th 2016, the European Parliament published a new regulation on the protection of natural persons with regard to the processing of personal data and on the free movement of such data – the General Data Protection Regulation (REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL). This Regulation was put in place on May 25th 2018 and repealed Directive 95/46/EC on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

Centro de Artes do Espectáculo de Viseu (CAEV) assumes the commitment to comply with the General Data Protection Regulation, as well as all legal obligations towards the Portuguese Republic and all European regulations applicable within the context of Data Protection and Privacy.

CAEV is fully committed to the protection of rights, liberties and guaranties of all natural persons who visit this website and use the services provided wherein (henceforth designated as Data Subjects), and the secure processing of their personal data, in compliance with all its legal obligations.
 
2. Definitions
CAEV’s Privacy Policy is based on the terms used by the European legislator when publishing the General Data Protection Regulation. This Policy must be intelligible and comprehensible to all Data Subjects who visit this website. Below, we define the principal terms used in our Policy:

  • Personal data. Any information relating to an identified or identifiable natural person («Data Subject»); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
     
  • Controller. The natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data;
     
  • Third party. Any natural or legal person, public authority, agency or body other than the Data Subject and Controller who, under the direct authority of the Controller, are authorised to process personal data;
     
  • Supervisory authority. An independent public authority which is established by a Member State of the European Union pursuant to Article 51 of the aforementioned Regulation. This authority is responsible for monitoring the application of all norms, guidelines and regulations regarding personal data processing, ensuring the protection of all human rights, freedoms and guarantees stated in the Constitution and the law;
     
  • Cookies. Cookies are small-sized files stored in an access device (computer, cellphone/smartphone and tablet), through a web browser, whenever a Data Subject visits a website. This cookie storage process allows websites to recognise the access device on future visits, and are, in some cases, indispensable to the functioning of said websites.

 
3. Data Controller
CAEV is the sole entity responsible for the website www.teatroviriato.com and all services within made available to the Data Subjects. Within the context of the General Data Protection Regulation, CAEV is the Data Controller because they determine the purposes and means of the processing of personal data.
Using this website and all services made available within may imply that a Data Subject’s data is subjected to data processing procedures. In accordance to their commitment to Privacy, CAEV safeguards the Privacy and Protection of all Data Subjects’ personal data.

If a Data Subject wishes to exercise any of their rights related to data protection or privacy, or if they need to discuss or relate anything else regarding these subjects, namely the reporting of incidents or filing of complaints, they may contact us through the aforementioned means, without neglecting to identify a means of response (phone, e-mail address our others) so that we can reply to their query or grievance.

4. Collection and Processing of Personal Data
Teatro Viriato’s website collects personal data when a Data Subject uses or activates certain services or functionalities This personal data may be submitted by the Data Subjects themselves so that they may take advantage of those same services or functionalities, or it may be collected through simple usage of the website, namely through access, information searching and other transactions.

Within the ambit of the aforementioned services and functionalities, the collected data may take the form of name, physical address, email address, phone number, as well as other personal identifiers. Before or during the collection and processing of their personal data, Data Subjects will always be informed of the purpose for the data collection. Express consent, on the part of the Data Subject, regarding the collection and processing of their personal data will always be required.

CAEV uses, in their official website, "Cookies" with the purpose of bettering its performance and delivering an overall superior browsing experience to all natural persons (Data Subjects) who may visit said website and use the services available, by providing higher response speed and efficiency while also eliminating the need for the Data Subjects to repeatedly provide the same information.
 
6. Newsletter subscription form
CAEV makes available to all Data Subjects the opportunity to subscribe to the newsletter that divulges their activities and products. The form used for this effect describes each type of collected data, and informs Data Subjects of the purpose of the collection, as well as their rights regarding personal data. At the moment of newsletter subscription, the Data Subject is required to give express consent so that the newsletter may be sent to them.

The newsletter can only be received by the Data Subject if they have provided a valid email address and have explicitly asked to receive it. After the subscription submission, a confirmation email will be sent to the Data Subject – a double opt-in procedure – allowing them to confirm the ownership of the email address used for the subscription, and attesting to their explicit consent in receiving the newsletter.

Personal data collected during newsletter subscription will only be used for purposes of sending the newsletter. The Data Subject may be informed, via email, of changes and updates to the newsletter service or other related changes, relevant to the Data Subject, for the full exercise of their rights. 

There will be no transfer of personal data collected by the newsletter service to any third parties. The newsletter subscription may be cancelled at any time by the Data Subject. The consent given by the Data Subject when subscribing to the newsletter, authorising the collection, processing and storage of their data may be rescinded at any time.
The rescission of consent may be requested through a link properly identified present in each issue of the newsletter. This rescission of consent may also be requested through any of the CAEV contacts made available in this Policy.
 
7. Rights of the Data Subject
Within the context of using the website www.teatroviriato.com and its services and functionalities, Data Subjects may, at any moment, exercise their data protection and privacy rights, namely: right of access to their personal data; right to rectification of inaccurate or incomplete personal data; right to erasure of their personal data, if allowed by law; right to rescind any consent of data collection and processing previously given; right to data portability; and the right to limit or oppose the processing of their personal data in the terms and conditions of the General Data Protection Regulation and any other additional applicable legislation.

All requests, by Data Subjects, to exercise rights of data protection and privacy, must be prompted by the Data Subjects themselves and addressed in writing to CAEV, through the means of contact made available in this Policy.
 
8. Principles relating to processing of personal data
CAEV, in compliance with this Policy and their own Responsibility towards Data Subjects concerning their data protection and privacy fulfils all fundamental principles of personal data processing, as stated in Article 5 of the General Data Protection Regulation, namely lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity, confidentiality and availability.

CAEV assures their compliance with all stated Principles, demonstrating said compliance within the context of all data collection and processing performed through their services and functionalities made available on the website www.teatroviriato.com. CAEV may be required to demonstrate their compliance with these Principles to any entity or organization that holds legal authority to request it.
 
9. Lawfulness of data processing
Within the context of using the website www.teatroviriato.com and its services and functionalities, CAEV conducts personal data processing procedures for which they have a basis of lawfulness, be it because the Data Subject has given consent to the processing of their personal data, or because processing is necessary for the performance of a contract to which the Data Subject is party or in order to take steps at the request of the Data Subject prior to entering into a contract. 11. Period of data storage
